Texas substantially changed the eligibility rules in 2011. Now a spouse must first prove that after divorce he or she will not have enough income to meet his or her monthly expenses.
To be eligible a spouse must also prove at least one of the following:
- They were married for 10 or more years and the spouse asking for support has tried since the divorce to support himself or herself.
- There is a conviction for family violence.
- The spouse requesting support has an incapacitating disability.
A child or children of the marriage have a disability that requires the requesting spouse to give extended care to that child or those children.

I'm an Air Force Veteran who came home after 8 years of service only to become bitterly embroiled in a custody battle that lasted 4 years over multiple lawsuits. As you may know, the odds of winning custody of your children in Texas are similar to the odds of winning the lottery. This is especially difficult if you are Active Duty, or a Veteran that has deployed overseas. Opposing counsel will try to paint you as an absentee parent due to overseas service.
